PROGRAM OUTLINE
This program is designed for Lawyers, Mental Health professionals, Certified Divorce Specialists, Accountants and other professionals who wish to practice Collaborative Family Law. The course is divided into 2 Levels:
- Level 1 (2 days) - offers both theory and process training for those who wish to add Collaborative Family Law to their practice.
- Level 2 (3 days) - offers the necessary skills to carry out the theory.
These 5 days of training are approved training for members of Collaborative Practice Toronto.
LEVEL I - THEORY AND PROCESS TRAINING
OBJECTIVES
- To understand the key principles of interest-based bargaining
- To acquire the communication skills necessary to model constructive problem solving
- To understand the differences between Collaborative Family Law and other dispute resolution alternatives
- To acquire sufficient knowledge about the professional and ethical requirements that distinguish this type of practice
- To learn the typical steps in a Collaborative Family Law case
- To understand the roles of various professionals in the Interdisciplinary Model
- To gain preliminary skills in initiating a Collaborative Family Law file
METHODOLOGY
The material is taught through short lectures, demonstrations, role-plays, case studies and group discussions. Intensive coaching is provided during small group role plays.

LEVEL 2 - SKILL BUILDING
OBJECTIVES
- To practice the communication skills necessary to manage difficult conversations
- To practice the various steps in an interest-based Collaborative Law Model
- To learn when and how to partner with other professionals to assist the Collaborative Team, including the "rules of engagement"
- To screen for appropriateness, including power imbalances and domestic violence
- To develop strategies for dealing with impasses
- To draft documents to maintain collaborative communication
- To anticipate and avoid ethical dilemmas
- To become familiar with several models of Collaborative practice
METHODOLOGY
This course follows a comprehensive case from beginning to completion with short lectures, demonstrations, role-plays, and intensive coaching feedback. Participants will role-play the various steps in a collaborative case and then draft an agreement following the Collaborative Model. The small group intensive coaching is provided to enhance the learning experience and is probably the most valuable learning opportunity.
