PROGRAM OUTLINE

This program is designed for those who wish to practice Collaborative Family Law. We have divided the Collaborative Family Law course into 2 Levels:

  • Level I (2 days) serves 2 purposes. It offers both theory and process training for lawyers who wish to add Collaborative Family Law to their practice.
  • Level II (3 days) offers the necessary skills to carry out the theory.

LEVEL I - THEORY AND PROCESS TRAINING
May 11 & 14, 2004

OBJECTIVES OF LEVEL I

Our objectives in Level I are to help you:

  • understand the key principles of interest-based bargaining;
  • understand the differences between Collaborative Family Law and other dispute resolution alternatives;
  • acquire sufficient knowledge about the professional and ethical requirements that distinguish this type of practice; and
  • learn the typical steps in a Collaborative Family Law case.

METHODOLOGY

The material is taught through short lectures, demonstrations, role-plays, case studies and group discussions. We believe that the most effective way to learn is to be involved actively in the exercises, discussions and especially the role-plays. Procedures that sound easy conceptually often prove quite challenging upon application.


LEVEL II - SKILL BUILDING
June 24 - 26, 2004

OBJECTIVES OF LEVEL II

Our objectives in Level II are to ensure that you:

  • acquire the communication skills necessary to model constructive problem solving
  • practice the various steps in an interest-based Collaborative Law Model
  • learn when and how to partner with other professionals to assist the Collaborative Team, including the "rules of engagement"
  • screen for appropriateness, including power imbalances and domestic violence
  • develop strategies for dealing with impasses
  • draft documents to maintain collaborative communication
  • anticipate and avoid ethical dilemmas

METHODOLOGY

This course follows a comprehensive case from beginning to completion with short lectures, demonstrations, role-plays, and coaching feedback. Participants will role-play the various steps in a collaborative case and then draft an agreement following the Collaborative Model.


At the completion of the 5 day program participants who choose to join the Ontario Collaborative Law Association, will have completed the training requirements for the Collaborative Family Law Roster.
