ADVICE FOR PARTIES IN MEDIATION

HOW CAN MEDIATION HELP YOU?

  • Mediation is a cooperative process used to help parties resolve conflicts. The goal is a fair and reasonable agreement that meets the significant needs of all parties.
  • Mediation encourages constructive communication in a non-adversarial atmosphere. The Mediator acts as a facilitator helping the parties generate win/win alternatives in a cooperative setting.
  • Mediation is most appropriate for couples who are prepared and able to negotiate in good faith, keep their commitments and put the children's needs first.
  • Mediation leads to agreements that last because they are reached voluntarily, without duress, and take into account the unique concerns and the creative input of the parties.

WHY IS MEDIATION SO SUCCESSFUL?

  • The parties control the outcome of their dispute - unlike litigation or arbitration in which a third party makes a decision.
  • Mediation improves communication, understanding of each other's needs and encourages win/win results.
  • Mediation is a focused form of problem solving - it is not therapy and it does not lead to an imposed settlement.
  • Mediation saves time and money compared to other forms of dispute resolution - especially litigation.
  • For parties who need or want to retain an ongoing relationship, mediation reduces anger and encourages future cooperation.
  • Mediated agreements tend to last longer than agreements that are imposed by a third party.
  • Mediation is a confidential process. Parties decide what role, if any, they wish a mediator to play, should one or more issues not be resolved in mediation.
